Navigaze terms

These are the rules for using Navigaze and paying for Navigaze Pro. We have tried to write them so you can actually read them: what we promise, what you are responsible for on the road, how billing and refunds work, and what happens if something goes wrong.

1. Who we are, and this agreement

Navigaze is sold by Sufi Plugins (Lucas Crowley), Maryland, USA, and built with Dawson Margeson ("we", "us"). Contact: help@navigaze.org. Postal address available on request at help@navigaze.org.

"Navigaze" means the Navigaze app for Even Realities G2 glasses, the Navigaze servers that answer its requests and store data for it (including the community and Convoy relays), and this website. These Terms are an agreement between you and us. You accept them by ticking the box at checkout, or by accepting the safety notice in the app, which says so. If you do not agree, do not use Navigaze.

Our Privacy Policy explains what data Navigaze handles and why, and forms part of these Terms.

2. Who can use Navigaze

You must be 18 or older to use Navigaze. By using it you confirm that you are, and that you hold whatever licence the law requires for the vehicle you are operating.

You are responsible for driving, riding and walking safely, and for obeying the law where you are. In particular:

5. Motorcycles, bicycles and walking

The Motorcycle and Bike modes, and any use of Navigaze on a motorcycle, moped, scooter, bicycle or on foot, are at your own risk. Two-wheeled vehicles leave less margin for a wrong turn, a missed limit or a moment's distraction, and glasses can be affected by wind, rain, vibration and helmets. Ride so that you could safely do without the display at any moment. Bike and walking routes may use paths, surfaces or roads that are not suitable for you or not permitted; judge them yourself.

6. Convoy

Convoy shares your position, chat and push-to-talk voice with a group you join with a password. Only share a Convoy with people you trust, since everyone in it sees where you are while it runs. You can leave at any time, which stops the sharing. Never use Convoy, or any part of Navigaze, to track or monitor another person without their knowledge and agreement. Convoy is a convenience for riding together, not a safety or emergency channel: it can drop out without warning, and voice is not end-to-end encrypted (see the Privacy Policy).

7. Subscriptions, billing and refunds

Plans and prices

Navigaze is free, on open data. Navigaze Pro is a paid subscription that adds commercial data and services (traffic-aware routing, speed limits from commercial road data, live community reports, cloud voice search, shared bikes and scooters, cloud backup). The price, the billing period and what is included are shown before you subscribe. Prices are in US dollars. At the date above, Pro is $4.99 a month or $49.99 a year.

Free trial and automatic renewal

A new Pro subscription starts with a free trial of 3 days. If you do not cancel before the trial ends, PayPal charges the plan price at the end of the trial and then every month or every year, at the price shown when you subscribed, until you cancel. We may refuse a repeat free trial.

Payment

Payments are handled by PayPal, under PayPal's own terms. We never see your card or bank details. If a renewal payment fails, PayPal retries it for about ten days and Pro keeps working meanwhile; if it still fails, the subscription ends.

How to cancel

Cancel any time in PayPal (Settings, then Automatic payments, then Navigaze Pro), or email help@navigaze.org and we will cancel it for you. Cancelling stops the next renewal. You keep Pro until the end of the period you have already paid for, or until the end of the trial if you cancel during it, in which case you are not charged at all.

Refunds

If you ask within 14 days of your first paid charge, or within 14 days of an annual renewal, we refund that charge in full, no questions asked. This also covers the right to withdraw that consumers in the EU and UK have. Just email help@navigaze.org. When we refund a charge, Pro ends on that subscription and we cancel it so you are not charged again. Outside those 14 days, charges are not refundable, except where the law gives you a right to a refund; where the law gives you more than this, you get more.

Price changes

We will email you at least 30 days before a price change applies to your subscription, and it applies from your next renewal after that notice. If you do not want to pay the new price, cancel before that renewal.

Promotional and complimentary licences

Licences given through a promo code, a giveaway or as a courtesy may be limited in time, and we may end them, with at least 30 days' notice where we have your email address. They cannot be exchanged for money.

Your own API keys

Instead of Pro, you can enter your own keys for TomTom, HERE, Google, Mapbox or a speech provider. You pay those providers directly under their terms, and we are not responsible for their service or their charges.

8. Third-party data and Even Realities

Maps, places, routes, speed limits, traffic, transit, weather, camera locations and shared-vehicle availability come from third parties (OpenStreetMap and services built on it, TomTom, public open-data programmes, transit and rental operators, and the providers named in the Privacy Policy) and are provided as they come. We do not control them, cannot verify them, and make no promise about their accuracy, completeness or availability. Map data is © OpenStreetMap contributors and is used under the Open Database Licence.

Navigaze is an independent app. Even Realities is not a party to these Terms and is not responsible for Navigaze, its content or its support; your use of the glasses and the Even app is governed by Even Realities' own terms. Community reports are written by other users, not by us, and may be wrong or malicious.

To the extent the law allows, Navigaze is provided "as is" and "as available". We do not promise that it will be uninterrupted, error-free or suitable for a particular purpose, or that its directions, speed limits, alerts or any other output will be accurate, complete or timely. Nothing in these Terms removes rights you have under consumer protection law that cannot be excluded or limited by contract.

12. Limitation of liability

To the extent the law allows:

None of this limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that the law does not allow to be limited.

13. Indemnity

To the extent the law allows, you agree to cover our reasonable costs, including legal fees, of claims brought against us by other people because of your unlawful use of Navigaze: for example, driving unlawfully with a head-worn display, using camera or police alerts where they are banned, or tracking someone through Convoy without their agreement. This does not apply to consumers where the law does not allow it.

14. Governing law and disputes

These Terms are governed by the laws of the State of Maryland, USA, and disputes go to the state or federal courts located in Maryland. Either of us can instead bring a claim in a small-claims court that has jurisdiction. There is no arbitration clause and no class-action waiver in these Terms.

If you live in the European Union or the United Kingdom, you keep the protection of the mandatory consumer law of the country where you live, and you can bring a claim in the courts there.

Before going to court, please email help@navigaze.org: most problems are solved faster that way.
